<h3>Premessa</h3>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Il
rinnovo del Contratto Integrativo Provinciale si inserisce in una fase di
rilascio di nuove licenze ex art. 134 e seg.ti T.U.L.P.S. e di ampliamenti
territoriali di quelle esistenti. <o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Le
parti ritengono, di conseguenza, indispensabile vigilare affinch&eacute; tu=
tti
gli Istituti di Vigilanza, sia quelli gi&agrave; operanti che quelli che
potrebbero operare in forza di eventuali future licenze, svolgano la propria
attivit&agrave; nel pieno rispetto:<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-left:1.0cm;text-align:justify;text-ind=
ent:
-1.0cm'><span style=3D'font-size:12.0pt'>a)<span style=3D'mso-tab-count:1'>=
&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>del
Contratto Collettivo Nazionale di Lavoro e del Contratto Integrativo
Provinciale di cui &egrave; parte integrante in quanto stipulato con
l'assistenza di Associazioni di categoria firmatarie del C.C.N.L.; <o:p></o=
:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>b)<span
style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>delle tarif=
fe di
legalit&agrave;, cos&igrave; come periodicamente decretate dal Prefetto; <o=

<p class=3DMsoNormal style=3D'margin-left:1.0cm;text-align:justify;text-ind=

modalit&agrave; operative e normative, cos&igrave; come prescritte dal Pref=

in licenza e nel Regolamento del Questore. <o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Ritengono,
infatti, indispensabile prevenire ogni fenomeno di concorrenza sleale nociva
per il mantenimento dei livelli occupazionali e retributivi dei lavoratori.=
 per
la sicurezza sul lavoro e per la qualit&agrave; dei servizi: convinzione
d'altronde condivisa dal Prefetto di Bari nella Sua comunicazione del
25/01/2003 all'Ufficio Vertenze Collettive della Provincia di Bari, con cui=
 afferma
che &quot;nell'autorizzazione all'esercizio dell'attivit&agrave; di vigilan=
za
privata viene richiamato, tra le prescrizioni, il rispetto dei Contratti
Collettivi&quot;.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'><o:p>&nbsp;</o:p></span></p>

<h3>VALIDITA' E SFERA DI APPLICAZIONE DEL CONTRATTO</h3>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>.<o:p></o:p></span></p>

<p class=3DMsoHeading7>Art.1</p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Il
presente Contratto Collettivo Integrativo disciplina, in maniera unitaria, =
il
rapporto di lavoro dei dipendenti da Istituti di Vigilanza Privata operanti=
 in
Bari e Provincia. In quanto stipulato anche da pi&ugrave; Associazioni
firmatarie del C.C.N.L., esso e parte integrante del vigente C.C.N.L. e, co=
me
tale, deve essere applicato, al pari dello stesso, da tutti gli Istituti di
Vigilanza comunque costituiti.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'><o:p>&nbsp;</o:p></span></p>

<p class=3DMsoHeading7>Art.2</p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Il
presente Contratto, per tutto il periodo della sua validit&agrave;, deve es=
sere
considerato un complesso normativo inscindibile, che, essendo globalmente di
miglior favore, per le materie qui trattate annulla e sostituisce ad ogni
effetto le norme di tutti i precedenti Contratti Integrativi Provinciali.<o=
:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Per
quanto non previsto dal presente Contratto valgono le disposizioni di legge
vigenti in materia, quelle del Contratto Collettivo Nazionale di Lavoro
vigente, dei Contratti Integrativi provinciali precedenti e degli accordi
aziendali se ed in quanto oggi applicati.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'><o:p>&nbsp;</o:p></span></p>

<h3>RELAZIONI SINDACALI - FORMAZIONE</h3>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'><o:p>&nbsp;</o:p></span></p>

<p class=3DMsoHeading7>Art.3</p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Le
parti, nel definire il presente accordo, hanno inteso perseguire una maggio=
re
qualificazione<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>delle
relazioni sindacali, sia a livello territoriale che aziendale, nel rispetto
delle reciproche autonomie e responsabilit&agrave;.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Allo
scopo di dare concreta attuazione a quanto previsto dall'art. 9 del vigente
C.C.N.L., in materia di informazione, gli Istituti forniranno semestralmente
alle strutture sindacali provinciali firmatarie del presente contratto,
contestualmente e congiuntamente con le RSU-RSA, informazioni con particola=
re
riferimento a:<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>a)
<span style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp; </span>fenomeni co=
nnessi
all'evoluzione dei servizi sull'organizzazione del lavoro esistente e su<o:=
p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify;text-indent:1.0cm'><span
style=3D'font-size:12.0pt'>eventuali riflessi occupazionali;<o:p></o:p></sp=
an></p>

<p class=3DMsoNormal><span style=3D'font-size:12.0pt;mso-bidi-font-size:10.=

style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span> prospettiv=

sviluppo anche in relazione ad investimenti aziendali e nuove tipologie di

<p class=3DMsoNormal><span style=3D'font-size:12.0pt;mso-bidi-font-size:10.=
0pt'>Cos&igrave;
come previsto dall'art. 11 del vigente C.C.N.L., le parti, previa
autorizzazione dell'Ente Bilaterale Nazionale, auspicano la costituzione
dell'Ente Bilaterale della provincia di Bari.<o:p></o:p></span></p>

<p class=3DMsoNormal><span style=3D'font-size:12.0pt;mso-bidi-font-size:10.=
0pt'>Gli
scopi dell'Ente Bilaterale sono quelli previsti dal C.C.N.L., ed in
particolare:<o:p></o:p></span></p>

<p class=3DMsoNormal><span style=3D'font-size:12.0pt;mso-bidi-font-size:10.=
0pt'>-<span
style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span=
>predisporre
programmi e moduli formativi, anche in relazione a quanto previsto dall'art=
. 25
del C.C.N.L., individuando i fabbisogni formativi a livello regionale e
specifici della provincia di Bari;<o:p></o:p></span></p>

<p class=3DMsoNormal><span style=3D'font-size:12.0pt;mso-bidi-font-size:10.=
0pt'>-<span
style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span=
>attivare
gli organismi per la composizione delle controversie cos&igrave; come previ=
sto
dagli <span style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp; </span>artt.=
 12,
13 e 14 del vigente C.C.N.L..<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Ulteriori
scopi dell'Ente sono quelli di attivare idonea iniziativa atta a garantire =
il
mantenimento dei livelli qualitativi dei servizi prestati dalle aziende
nell'ambito di una equilibrata prospettiva di sviluppo che salvaguardi le
esigenze di sicurezza delle Guardie Particolari Giurate addette ai servizi.=
<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Le
parti nell'esprimere, infatti, viva preoccupazione circa la possibile
evoluzione, anche di ordine occupazionale, del settore, si propongono di
intervenire nelle sedi opportune al fine di evitare crisi strutturali dovut=
e ad
una esasperata concorrenzialit&agrave; stante la presenza di un numero di
Istituti in eccesso rispetto alle richieste di servizi.<o:p></o:p></span></=
p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Sempre
a questo riguardo le parti convengono sulla necessit&agrave; di intervenire=
, in
tutte le opportune sedi, affinch&eacute; vengano repressi i comportamenti d=
elle
organizzazioni che offrono e svolgono prestazioni del tutto simili a quelle
regolate e sanzionate dal T.U.L.P.S., senza essere munite della indispensab=
ile
licenza di P.S., camuffando detti servizi come fossero di custodia o
portierato.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Ulteriori
scopi dell'Ente saranno dunque:<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-left:1.0cm;text-align:justify;text-ind=
ent:
-1.0cm'><span style=3D'font-size:12.0pt'>-<span style=3D'mso-tab-count:1'>&=
nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>esprimere
il proprio motivato parere in ordine al rilascio di nuove licenze e/o di es=
tensioni
di quelle esistenti;<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>-<span
style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span=
>vigilare
circa la corretta applicazione del C.C.N.L. ed Integrativi Provinciali;<o:p=
></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-left:1.0cm;text-align:justify;text-ind=
ent:
-1.0cm'><span style=3D'font-size:12.0pt'>-<span style=3D'mso-tab-count:1'>&=
nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>individuare
percorsi che consentano di accelerare le procedure di rilascio delle
autorizzazioni abilitanti a svolgere le mansioni di G.P.G.;<o:p></o:p></spa=
n></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>-<span
style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span=
>verificare
l'utilizzo, nel settore, dei lavori socialmente utili;<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-left:1.0cm;text-align:justify;text-ind=
ent:
-1.0cm'><span style=3D'font-size:12.0pt'>-<span style=3D'mso-tab-count:1'>&=
nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>intervenire,
in tutte le opportune sedi, affinch&eacute; vengano represse, in quanto
illecite, le attivit&agrave; di vigilanza e custodia che rappresentano una
concorrenza sleale, scorretta e non autorizzata se svolte in assenza della
indispensabile Licenza ex art. 134 e ss. del T.U.L.P.S.;<o:p></o:p></span><=
/p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>-<span
style=3D'mso-tab-count:1'>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span=
>verificare
e monitorare quanto previsto al successivo art. 9 del presente contratto.<o=
:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'><o:p>&nbsp;</o:p></span></p>

<p class=3DMsoHeading7>Art.5</p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>In
attesa della costituzione dell'Ente Bilaterale, le parti convengono di
istituire un Organismo Paritetico Territoriale composto da n. 3 componenti
effettivi e n. 3 supplenti per ciascuna parte, da accreditare presso la
Prefettura ed avente lo scopo di svolgere i compiti dell'Ente stesso.<o:p><=
/o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Gli
incontri dell'Organismo avverranno, di norma, ogni 4 mesi su richiesta di u=
na
delle parti.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>L'Organismo
Paritetico Territoriale ha assorbito le funzioni e competenze della Commiss=
ione
Vigilanza Privata di cui all'art. 2 punto A del C.I.P. 24 febbraio 1993 ed =
ha
anche competenza ad esaminare particolari situazioni per fatti, diversi
rispetto a quelli che hanno rilevanza penale, che potrebbero portare alla
sospensione e/o revoca delle autorizzazioni a svolgere le mansioni di G.P.G=
..<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'><o:p>&nbsp;</o:p></span></p>

<p class=3DMsoHeading7>Art.6</p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Le
parti, nel rivendicare il loro esclusivo diritto-dovere nel promuovere la
formazione professionale dei lavoratori ed in attesa di quanto verr&agrave;
attuato in sede di Enti Bilaterali Nazionale e/o Regionale e/o Provinciale,
ritengono di dover definire, sin d'ora, alcune linee guida in materia di fo=
rmazione
ed aggiornamento professionale.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Pertanto,
concordano quanto di seguito:<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'margin-left:1.0cm;text-align:justify;text-ind=
ent:
-1.0cm'><span style=3D'font-size:12.0pt'>a)<span style=3D'mso-tab-count:1'>=
&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>Alle
aspiranti G.P.G. verranno consegnati, a cura degli Istituti, moduli formati=
vi
finalizzati alla conoscenza dei compiti e dei diritti-doveri della G.P.G.,
delle prescrizioni, delle cautele, della sicurezza sul lavoro, delle tecnic=
he
operative per l'esecuzione dei singoli servizi degli apparati ricetrasmitte=
nti;
unitamente ai moduli formativi verr&agrave; consegnato un questionario che =
le
G.P.G. dovranno compilare e riconsegnare sottoscritto prima dell'assunzione=
 al
fine di stabilire il grado di addestramento. Sempre prima dell'assunzione le
stesse dovranno addestrarsi all'uso delle armi ed ottenere, secondo le legg=
i ed
i regolamenti in vigore, la licenza di porto di pistola.<o:p></o:p></span><=
/p>

<p class=3DMsoNormal style=3D'margin-left:1.0cm;text-align:justify;text-ind=
ent:
-1.0cm'><span style=3D'font-size:12.0pt'>b)<span style=3D'mso-tab-count:1'>=
&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>Dopo
l'assunzione, previa una formazione pratica sull'utilizzo degli apparati
ricetrasmittenti che sar&agrave; svolta in affiancamento operativo con G.P.=
G.
esperte, entro i primi sei mesi di attivit&agrave;, verranno impartiti cors=
i di
addestramento teorico secondo adeguati percorsi formativi, occorrendo media=
nte
I'ausilio di enti esterni.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Qualora
l'assunzione si riferisca a un lavoratore che abbia effettuato l'addestrame=
nto,
come sopra precisato, presso altro Istituto di vigilanza negli ultimi 12 me=
si,
il medesimo sar&agrave; esonerato dall'attivit&agrave; addestrativi presso
l'Azienda di nuova assunzione.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>L'attivit&agrave;
formativa di cui al presente punto b) s'intende retribuita ed i relativi co=
sti
saranno a totale carico degli Istituti.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'><o:p>&nbsp;</o:p></span></p>

<p class=3DMsoHeading7>Art.7</p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>A
cura dell'Istituto le G.P.G. sono informate, mediante conferenze o adeguati
corsi di aggiornamento, dell'eventuale sopravvenienza di norme abrogative e
sostitutive di precedenti disposizioni.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Ogni
sei mesi o, comunque, secondo le disposizioni prefettizie, ciascuna guardia
giurata effettua esercitazioni di tiro con l'arma in dotazione.<o:p></o:p><=
/span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Per

circostanze che hanno determinato il provvedimento di sospensione o revoca.=

il mantenimento dei livelli occupazionali e l'organizzazione del lavoro, al=
le
OO.SS. competenti per territorio e firmatarie del presente accordo, fornendo
contestualmente tutte le informazioni utili in relazioni ai turni, ai nastri
orari ed agli organici.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>L'Istituto
subentrante, anch'esso con la massima tempestivit&agrave; possibile e,
comunque, prima del verificarsi dell'evento, dar&agrave;, a sua volta, form=
ale
comunicazione alle OO.SS. competenti per territorio e firmatarie del presen=
te
accordo in merito all'organizzazione del nuovo servizio.<o:p></o:p></span><=

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=
12.0pt'>Le
parti (OO.SS. firmatarie, Istituto uscente, Istituto subentrante) concordano
che saranno effettuati con le OO.SS. incontri di verifica preventivi all'ev=
ento
considerato, circa le condizioni inerenti l'organizzazione del lavoro ed il
mantenimento dei livelli occupazionali.<o:p></o:p></span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><span style=3D'font-size:=

caso di esito negativo della verifica di cui sopra, le parti chiederanno la
convocazione presso l'Ufficio Vertenze Collettive della Provincia di Bari p=

corso di tali incontri verranno verificate le eventuali necessit&agrave; di

ai risultati conseguiti dalle aziende e subordinato ad indici attribuibili =

premio suddetto &egrave; dovuto anche ai lavoratori assunti con contratto di
